    C-Section Errors

    Labor and delivery was mismanaged and the parents brought suit against the local hospital, the midwifery care group, and the certified nurse midwife, who failed to respond appropriately to signs of abnormalities, including the failure to respond to arrested labor, continuing to attempt vaginal birth after the mother had a previous cesarean birth, and the inappropriate use of labor enhancing drugs. This led to a ruptured uterus, necessitating an emergency C-section which caused the baby to suffer from brain injuries due to asphyxia, blood aspiration, respiratory distress, and aspiration syndrome. The child was later diagnosed with cerebral palsy and other impairments related to the asphyxia. She requires ongoing long-term care, supervision, and treatment.

    Neurological Injuries

    A mother’s symptoms required her to be seen in-person after the first phone call, yet the doctor neglected the standard of care by advising the plaintiff to stay at home. It was argued that the baby would not have suffered from prolonged oxygen deprivation if the mother was seen and the baby delivered earlier.

    Thus, the child suffers from pulmonary hypertension from meconium aspiration, permanent brain injury, multi organ dysfunction, and hypoxic ischemic encephalopathy. Damages for past and future medical expenses, physical pain, emotional suffering, were sought.     Negligent Prenatal Care

    During her second pregnancy, our client sought treatment for pain in her left lower quadrant from the defendant, her OB/GYN. The defendant then failed to perform proper radiology and laboratory testing and misdiagnosed the pain as an unruptured ectopic pregnancy, instead of ovarian cysts in a healthy pregnancy. Thus, methotextrate was administered to medically abort the pregnancy and the plaintiff suffered and incomplete and unwanted abortion, significant pelvic and abdominal pain, vaginal cramping and bleeding, nausea, and severe headaches. In addition, our client continues to suffer from serious emotional distress because of the loss due to the defendant’s negligence.
